RESERVATIONS AND PAYMENTS: The initial payment amount (50% of total if more than 30 days out from check-in) together with a completed Short Term Lodging Agreement must be received and approved by Villa Rentals, Inc. before a confirmation will be issued. No grace period will apply. Final payment, consisting of the remaining balance, must be received by Villa Rentals, Inc. at least thirty (30) days prior to guest arrival (or immediately if booked less than thirty (30) days in advance of guest arrival). Failure to make final payments on a timely basis will make reservation subject to automatic cancellation.
DAMAGES/FINES EXCEEDING DAMAGE WAIVER LIMITS: Guest agrees to pay for all damages and fines in excess of the $125 damage waiver limit as listed on the contract which covers up to $1,000 in accidental damages. Guests who paid on a credit card authorize Villa Rentals, Inc. to charge any additional damages on this credit card not to exceed $1,500. Villa Rentals, Inc. will provide detailed accounting to Guest (whether paid by cash or credit card) for all charges. If any monies are still owed, Guest agrees to pay those monies within 30 days of when the accounting is received.
VACATION RENTAL INSURANCE: Generali Travel Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for prepaid, nonrefundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. We strongly recommend you purchase this valuable protection. Separate terms and conditions apply, read your Description of Coverage/Policy carefully and contact Generali at 800-874-2442 with coverage questions.
CANCELLATION POLICY: Reservations can be canceled without penalty for at least 24 hours after the reservation is confirmed if the reservation is made 72 hours or more before the time of check in. Reservations canceled at least 30 days before the start of the stay will receive 100% refund. Reservations canceled at least 14 days before the start of the stay will receive 50% refund. Reservations canceled less than 14 days before the start of the stay will not receive a refund. Processing fees (Villa Rentals) and/or Management fees (VRBO) are not refundable for those confirmed reservations past the allowable 24 hour cancelation period.
TERM: If your reservation is 31 consecutive days or longer, the 10% city tax will be waived and subject to California Long Term Tenant/Landlord Rules and Regulations.
CHECK-IN: Most properties have keyless entry and your code will be sent ahead of time and activate at 3:00 pm the day of check-in. For those properties with keys they may be picked up at our office any time between 3:00 pm and 5:00 pm unless other instructions are given by Villa Rentals. Our office closes at 5:00 pm. Should you need a late arrival or you are checking in on a day when we are closed, please contact our office ahead of time and we will make other arrangements for your convenience. If there are any issues that need to be addressed at move in please contact us right away. We will make every attempt to remedy those issues as soon as possible. These units are individually owned so we can only resolve issues within our control. We cannot be held responsible for issues that were brought to our attention at or after move out so it is imperative that we communicate about any and all concerns at move in to make for an enjoyable stay. A welcome email will be sent about a few days prior to your arrival which will have more detailed information.
CHECK-OUT: Check-out time is 10:30 am – promptly. It is imperative that we are able to check the unit for cleaning, inventory and supplies beginning at 10:30 am in order to prepare for the next guest’s arrival. Guest agrees to vacate premises by office by 10:30 am unless otherwise agreed to by Villa Rentals. There will be a $50.00 charge for every hour or part thereof held over.
PARKING: Please refer to the website listing for the parking details of each property. Please read all posted parking regulations. Failure to adhere to these regulations will result in parking citations. When a citation is received the owner may also be fined $1,000 or more as it is in direct violation of the short term lodging permit conditions. Any fine imposed by the police or city for a parking violation will be charged to the guests credit card on file or by guests preferred method of payment. Villa Rentals will require detailed vehicle information.
OFFICE HOURS: June - August: 9am to 5pm - Monday through Saturday (closed on Sunday). September, March, April and May: 9am to 5pm - Monday - Friday and Saturday By Appointment Only (closed on Sunday). October - February: 9am to 5pm - Monday through Friday (closed on Saturday & Sunday).
PETS: Pets are not permitted on or about the premises. ADA service animals required because of a disability are allowed. ESA’s (Emotional Support Animals) are not allowed.
SMOKING: All of our properties are NON-SMOKING units.
FIRE PITS, GRILLS & BBQ'S: Guest agrees to only use above items provided by the owner at the unit unless special permission is given by Villa Rentals. No wood burning or excessive smoke is allowed on the premises including but not limited to wood burning fire pits, smokers or BBQ's.
AMENITIES: Our kitchens are supplied with all the basic dishes, utensils and cookware needed for everyday cooking. There is also some cleaning supplies and dry goods such as paper towels, toilet paper, coffee filters, trash bags, etc. to begin the vacation. However, Guest may need to purchase additional supplies to last throughout the stay. We do not provide personal toiletries other than shampoo, conditioner, body wash and hand soap.
AIR CONDITIONING: Many of the units do not have air conditioning. Please refer to the website listing for details on whether a unit provides A/C or not.
VISITORS: Guest will be responsible for any and all actions of visitors for the duration of the contract. Up to 4 additional guests above maximum occupancy are allowed through the early evening, however only the guests listed on your rental agreement are allowed to sleep at the unit per city occupancy laws.
SUBLET: Guest agrees to not sublet the unit or permit unauthorized guests (those not listed on the original contract) to reside at the premises without express permission from Villa Rentals. Violation of this rule will result in immediate forfeiture of the premises upon demand.
DISTURBANCES/NOISE AND PARKING VIOLATIONS: The City of Newport Beach has enacted ordinances concerning parties, loud music, excessive noise and any general disturbance of the peace as well as parking ordinances for street sweeping, etc. Fines under these ordinances can range anywhere from $1,000 to $3,000 or more as it is in direct violation of the short term lodging permit conditions. Any fine imposed by the police or city for a disturbance or parking violation will be charged to the guest using the credit card on file. Any valid disturbance reported to Villa Rentals or violation of these ordinances will result in immediate forfeiture of the premises upon demand. Please refer to the City of Newport Beach Good Neighbor Policy and Short Term Lodging Permit Conditions for details. Villa Rentals will require each guests' vehicle information. If you do not agree to these terms please let us know right away and we will cancel your reservation.
CORONAVIRUS/PANDEMIC/EPIDEMIC CONDITIONS: In the event of pandemic/epidemic conditions such as Coronavirus (COVID 19), the guest assumes the risk related to potential exposure. Villa Rentals will disinfect, clean and air out the unit prior to your arrival in accordance with the local public health authorities (including WHO and CDC). Guest agrees that such conditions are beyond Villa Rental’s control and if it impairs the vacation rental, Villa Rentals, Inc. is not responsible for finding alternate lodging for the renter or for the renter's financial losses related to transportation or alternate lodging. The guest agrees that the normal cancelation policy will apply. This includes but is not limited to unforeseen beach closures or restrictions as well as other community closures that are beyond Villa Rental’s control. However, Villa Rentals will issue a full refund in the event mandatory ordinances are enacted by the City of Newport Beach restricting short term lodging in the city.
NOTICE OF ABSENCE: You must tell us in advance if you will be absent from the property for 5 days or more. If you do not give us this notice, you will have to pay for any damage that may result from your absence.
BEDDING AND LINENS: Blankets, mattress pads, bed spreads, and pillows are provided. The cleaning fee includes a set of sheets on each bed, bath towels, hand towels, wash cloths and beach towels. **The cleaning fee does not include additional sheets or towels as each unit provides laundry facilities**
RIGHT OF ENTRY: Villa Rentals, Inc. retains the right to enter the premises with reasonable notice, during reasonable hours, to inspect or exhibit or repair the rental unit as required.
BUILDING CONSTRUCTION: Guest agrees to not hold Villa Rentals, Inc. accountable or demand a rent reduction due to neighboring building construction of which is not in Villa Rentals Control.
WIRELESS INTERNET & TV SERVICES: Guest agrees that the internet connectivity and TV services are provided by 3rd party companies and any issues arising from connectivity failures are not the responsibility of Villa Rentals, Inc.
LOST ITEMS: Guest agrees to not hold Villa Rentals, Inc. responsible for items lost or left behind during or at move out. Villa Rentals, Inc. will make every effort to retrieve items that have been reported, however there is no guarantee the items will be found and returned. ATTORNEY'S FEES: In the event of a dispute the prevailing party may not collect attorney’s fees in excess of $500.
REPAIRS: Villa Rentals, Inc. will make every effort to expedite a repair that is needed. Guest agrees to notify management immediately should something be in need of repair. If a repair is needed due to damage caused by Guest, Villa Rentals, Inc. and Guest will communicate on how the payment of this repair will be handled. Guest agrees that some repairs cannot be determined to be a Guests responsibility until the repair person has already been dispatched. Guest agrees to waive rent compensation for any unforeseen repair that cannot be remedied right away. INSURANCE: Guest understands that our insurance does not cover your belongings or damage that you cause. You agree that we are not responsible for any loss or damage during the term of the rental agreement. You agree to carry insurance covering all of your personal property located in the unit or bear full responsibility for its damage including damage from fire, water, theft, or any cause.
CATASTROPHIC EVENTS & EMERGENCY EVACUATIONS: If a catastrophe (hurricane, tornado, earthquake, flood, etc.) or any situation simply beyond our control impairs the vacation rental, Villa Rentals, Inc. is not responsible for finding alternate lodging for the renter or for the renter's financial losses related to transportation or alternate lodging. There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS. Whether you own property, run a business, or rent a condo in Newport Beach, the threat of an earthquake, flood or tsunami is always present and we all assume this risk. There will be no refunds of any kind for evacuations.
LIMITATION OF LIABILITY: Under no circumstances shall Villa Rentals, Inc. be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by Villa Rentals, Inc. or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; Villa Rentals, Inc., at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. Villa Rentals, Inc. will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Some activities in which guests engage are especially dangerous and include scuba diving, snorkeling, deep-sea fishing, boating, swimming, boogie boarding, surfing and biking. This list is not all-inclusive, but indicates some of the hazards of vacationing in Newport Beach. Guest and other invitees shall use the Spa (if applicable) at their own risk. Guest understands that there are certain inherent risks to person and property located adjacent to the ocean, including the possibility of drowning. Guest acknowledges that the owner would not rent the property unless the Guest accepted this condition. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, balconies/decks with spaces between rails (dangerous for little children), precipitous drop-offs on ocean floor, faulty electrical or plumbing systems, gas BBQ grills, fireplaces, clean/clear sliding glass doors, and dangerous stairs or pathways, Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this villa, you acknowledge that in all events and circumstances, Villa Rentals, Inc., its officers and employees shall not be liable. Villa Rentals, Inc. reserves the right to cancel or rescind any rental agreement if it is found that the Guests are conducting unlawful activities, not abiding by the Newport Beach Short Term Lodging Ordinances & House Rules , disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement.
